These Terms and Conditions ("Terms") govern your use of the Weather Zero desktop application ("the App"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree to these Terms, do not use the App.
1. License
Weather Zero grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or lease any part of the App or its software, nor may you reverse engineer or attempt to extract the source code of the App.
2. User Obligations
- Compliance: You agree to use the App in compliance with all applicable laws and regulations.
- Accuracy: While Weather Zero strives to provide accurate weather data, you acknowledge that weather conditions are inherently unpredictable, and the App may not always provide precise or timely information. Weather Zero is not responsible for any damages or losses that result from your reliance on the App’s information.
- Updates: Weather Zero may, at its discretion, provide updates to the App. You agree to install these updates to ensure the continued functionality and security of the App.
3. Privacy
Your privacy is important to us. Weather Zero may collect and use certain information as described in our Privacy Policy located at www.weatherzero.com. By using the App, you consent to such collection and use of your data.
4. Intellectual Property
All intellectual property rights in the App, including but not limited to, trademarks, trade names, logos, software, and content, are owned by Weather Zero or its licensors. These Terms do not grant you any rights to use these intellectual properties except as expressly provided.
5. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Weather Zero does not warrant that the App will be uninterrupted, error-free, or completely secure.
6. Limitation of Liability
To the fullest extent permitted by law, Weather Zero shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
- Your use or inability to use the App;
- Any unauthorized access to or use of our servers and/or any personal information stored therein;
- Any interruption or cessation of transmission to or from the App;
- Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App by any third party.
7. Termination
Weather Zero reserves the right to terminate or suspend your access to the App at any time, with or without cause or notice, effective immediately. Upon termination, the rights granted to you under these Terms will cease, and you must immediately uninstall the App.
8. Governing Law
These Terms are governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Florida for the resolution of any disputes arising out of or related to these Terms or the App.
9. Changes to These Terms
Weather Zero may update these Terms from time to time. Any changes will be effective immediately upon posting the revised Terms in the App or on our website. Your continued use of the App after the changes have been made will constitute your acceptance of the revised Terms.
By using Weather Zero, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
